Merchant Application Terms & Conditions

  1. General
    These terms and conditions will form an agreement (the “Agreement”) between you (the “Merchant”), and us Ooredoo Financial Services O.F.S. (“Ooredoo Financial Services”, “us”, “we”), upon successful completion of your registration as Merchant Wallet Holder.

  2. Definitions
    “Merchant” means the merchant who is forwarding authorized transactions for their processing by us.
    “Merchant Settlement Account” means the account nominated by you for acceptance of credit entries under this Agreement and for related purposes.
    “Merchant Application Form“ means the Ooredoo Money Merchant Application Form which sets out among documents, the types of transactions that the Merchant is authorized to process.
    “Authorized Personnel” means the employee of the Merchant authorized by the Merchant to open merchant wallet.
    “Payment Method” is the QR code based on process for accepting payments from customers by Merchant.
    “OM wallet customers” means Ooredoo Money customers who successfully registered for Ooredoo Money service.
    “Merchant Services Charge” means the transactions or settlement charges imposed on the Merchant.
    “Refunds” means transaction reversal back from the Merchant to the customer.
    “Rules” is the adopted written rules and regulations, system manuals, procedures and requirements, releases and interpretations thereof and other requirements (whether contractual or otherwise) issued by Qatar Central Bank, as well as their amendments and implementing regulations.
    “Service Provider or OFS” means the provider of any software and hardware that you utilize to assist with the acceptance of card and wallet payment details.
    “Service(s) or OFS Service(s)” the service(s) provided by the Service Provider to the Merchant as identified within attached Merchant Application Form.
    “Merchant Reports” means the statement of your account for payment transactions.
    “QR code” means Merchant identification code that the customer will scan to make the payment.
    “Terminal” means the POS hardware and software provided by Ooredoo Finical Services or its partners to accept payments.
    “Transaction” means sale accepting payment by Merchant using the payment methods supported by Ooredoo Financial Services.

  1. Services
    OFS will facilitate the Merchant to accept digital payment from OM wallet customers or e-wallets (as applicable) in return of sale of goods and services.
     
  2. Obligations
    4.1. Service Provider obligation
    1. OFS will provide the Merchant with credentials (username and password) to access OFS portal.
    2. OFS shall provide unique QR code to the Merchant.

    4.2. Merchant obligations
    1. Merchant should provide correct, valid, accurate and not misleading details and documentation to open Merchant wallet.
    2. Merchant should keep the system credentials (username and password) secure and not share them with anyone.
    3. Merchant shall allow OM Wallet Customers to make payment with OM wallet via available payment methods.
    4. Merchant will at all times display the OFS QR code and the options of OFS Payments Method.
    5. The Merchant shall inform OM Wallet Customers that Merchant and not OFS is liable for the following:
      1. Delayed delivery
      2. Defective goods
      3. Unsatisfactory service
      4. Unacceptable products or services
      5. Items return cost
    6. Merchant shall be liable for Merchant Service Obligations and shall fully indemnify OFS and keep OFS indemnified for any losses in relation to the Merchant Service Obligations.
    7. Merchant shall inform OFS as soon as it is reasonably practicable after Merchant becomes aware that Merchant Wallet and/or a Service is being accessed without Merchant’s authorization and/or used fraudulently. Merchant shall be liable for any loss or damage suffered by the Merchant as a result of unauthorized use of the Merchant Wallet and/or services (including fraud, loss or theft), up to the time that Merchant has notified OFS that the Merchant Wallet and /or any services is/are being used without the Merchant’s authorization.


  1. Acceptance
    By registering with, or using OFS portal for any general or specific purpose of availing Merchant Services, Merchant accepts the terms and conditions as detailed in these OFS Merchant Terms and conditions, these terms and conditions also include any additional or modified terms and conditions in relation to the Merchant Services, additional or modified service – specific terms and conditions in relation to any OFS Services or any future services that may be offered by Service Provider OFS on the OM portal as detailed on our website www.ooredoo.qa. If at any time the Merchant do not accept or agree with any of the T&C and does not wish to be bound by them, Merchant shall not access or use the OFS portal and the latter will immediately terminate use of the OFS services. The Merchant agrees and confirms its acceptance to the OFS Merchant Terms and Conditions and shall constitute a legal contract (hereinafter Agreement) between Merchant and OFS.
    All services are rendered by OFS through Ooredoo Money Portal or OFS provided applications under the brand name Ooredoo Money (or any derivatives or variations thereof).

  2. Eligibility
    Services can be availed by commercially requested and authorized organization in the state of Qatar. Valid commercial registration is mandatory for the registration and ongoing activity. In case of non-renewal in commercial registration, OFS will have full authority of terminating this Agreement with the Merchant immediately and/or suspend of the service(s), or take any other action that it sees necessary.

    The services are not available for persons previously suspended or removed by OFS from accessing the portal or Merchant payment service by accepting the terms and Conditions or by using the services. Merchant represents that it has not been previously suspended or removed by OFS or disqualified for any other reason from availing the services or using the Ooredoo Money Portal. Merchant represents and warrants that Merchant has the right, authority and capacity to enter into Agreement and to abide by all the T&C. Furthermore, Merchant shall not impersonate any person or entity, or falsely state or otherwise misrepresent their identity or affiliation with any person or entity. In case of any violation of the T&C, OFS has the right to suspend, close Merchant account or permanently prevent Merchant from using the service. OFS will reserve its right to report the Merchant/person to relevant authorities if required.

  3. Merchant Services Charges
    By signing this Agreement and T&C, Merchant accepts the charges mentioned in the Application Form or specified by OFS from time to time and communicated via its channels.

    Promotions on ad-hoc and /or campaign basis will be made available to the merchants and customers. This is at the sole discretion of Ooredoo, Ooredoo Money and / or its partners and / or affiliates and it is subject to change and amended at the discretion aforementioned parties at any time during the term.

  4. Settlement
    Settlement of accumulated payments will be done in the Merchant wallet and Merchant will be able to transfer those funds to a pre-specified account after login into the Merchant portal or Merchant app.

  5. Indemnification
    By signing this Agreement, Merchant agrees to indemnify, save, and hold OFS, its affiliates, employees, officers, directors and partners harmless from any and all claims, losses, damages, and liabilities, costs and expenses, including without limitation legal fees and expenses, arising out of or related to: (i) Merchant’s or Merchants employees us or misuse of the Ooredoo Money services or Ooredoo Money portal; (ii) Any violation by Merchant of this Agreement; (iii) Merchant use of the services infringes the intellectual property rights of the third party; (iv) any breach of the representations, warranties, and covenants made by Merchant herein. Ooredoo Financial Services reserves the right at Merchant expense, to assume the exclusive defense and control of any matter which Merchant are required indemnify OFS, including rights to settle, and Merchant agrees to cooperate with Ooredoo Money Services defense and settlement of these claims. Ooredoo Money Services will use reasonable effort to notify Merchant with any claims, action, or proceeding brought by third Party that is subject to the foregoing indemnification up on becoming aware of it.

  6. Termination
    Merchant agrees that OFS, in its sole discretion, with cause or without cause, and without penalty from OFS to the Merchant may suspend Merchant use of the Ooredoo Money portal account at any time. Upon termination, Merchant may retrieve outstanding amount from his Merchant wallet within (15) days provided there are no contradictions according to OFS internal policy; OFS will transfer the amount to Merchant’s Bank account provided and agreed upon during the registration process. OFS may also in its sole discretion and at any time discontinue providing access to the Ooredoo Money service and/or OM portal or any account Merchant may have or portion thereof may be effected without prior notice. And Merchant agrees that OFS will not be liable to Merchant or any third party for any such termination or interruption. Any suspected fraudulent, abusive or illegal activity may be referred to appropriate law enforcement authorities. These remedies are in addition to any other remedies OFS may have at law or in equity. Upon termination for any reason, Merchant agrees to immediately stop using the OM services and /or OM portal.

    Merchant may terminate this Agreement by providing Ooredoo Financial Services with thirty (30) days prior written notice.

    In case Merchant gets a waiver on deposit fee, set up fee or monthly rental then the Merchant cannot terminate the Agreement for 24 months from the date of signature. Otherwise, Merchant has to pay any waived amount during the contract period.

    In case merchant gets any special Value-Added Services, subsidized devices or marketing support from OFS then Merchant cannot terminate the Agreement for 24 months from the date of signature.

  7. Governing Law and Dispute Resolution
    (a) The courts of the State of Qatar are exclusively competent to adjudicate any dispute that may arise regarding the implementation of this Agreement or the interpretation of any of its terms and conditions, and the provisions of Qatar laws are applied in this regard.

    (b) If there are any inconsistencies between the Arabic text and the English text of this Agreement, the Arabic text will prevail
